Job Safety and Health Protection
The posting reflects new, inflation-adjusted penalty amounts for safety violations. Effective August 1, 2025, the maximum penalty rates are:

  • Serious violations – $16,287
  • Other-than-serious violations – $16,287
  • Failure to correct violations – $16,287
  • Willful or repeated violations – $162,849

The posting also includes an updated address for the OSHA Regional Administrator.

Covenants Not to Compete Prohibited
Pursuant to Senate Bill 1218 (2025), the law concerning non-compete agreements for low-wage employees has been amended. The definition of “low-wage employee” has been revised to include any employee who is entitled to overtime compensation under the Federal Fair Labor Standards Act (FLSA) for hours worked over 40 in a workweek, regardless of their average weekly earnings. The posting reflects this revised definition and clarifying language added to the statute to provide a better understanding of the law. 

EITC Earned Income Tax Credit
The posting has been revised to include a clearer explanation of the qualifying rules for married people based on their tax filing status. The posting has also been simplified by removing certain details about the consequences of tax filing errors, IRS audits, and fraudulent claims. 

Who Must Post?
  • All employers are required to post and keep posted the Job Safety and Health Protection posting in a conspicuous place where notices to employees are routinely posted. (16 V.A.C. 25-60-40)
  • Every employer is required to post the Covenants Not to Compete Prohibited posting where other employee notices required by state or federal law are posted. (Va. Code § 40.1-28.7:8(G))
  • Every employer must post the EITC Earned Income Tax Credit posting where other employee notices required by state or federal law are posted. (Va. Code § 40.1-28.7:3)
