Executive Order 13496 and U.S. Department of Labor (US DOL) regulations require Federal contractors and subcontractors to post a notice informing their employees of their rights under the National Labor Relations Act (NLRA). (See 29 CFR Part 471). The NLRA is the primary law governing relations between unions and employers in the private sector. The NLRA notice serves three functions:
- To inform employees about their rights under the NLRA to form, join and assist a union and to bargain collectively with their employer;
- To provide examples of unlawful employer and union conduct that interferes with those rights; and
- To provide contact information for the National Labor Relations Board (NLRB), the federal agency responsible for enforcing the NLRA.
NLRA Notice Content Updated
Recently, the US DOL updated the content of the NLRA notice. The NLRA notice reflects the new telephone number for the NLRB. The notice also provides new contact information for individuals who are deaf or hard of hearing. These individuals are instructed to contact the Federal Relay Service by visiting service’s the website at the provided URL, calling one of its toll-free numbers, and asking its Communication Assistant to call the NLRB using a specific toll-free number. The US DOL has announced that this is a mandatory update.
Posting Options
The regulations require the NLRA notice to be the same in size, form, and content as the poster provided by the US DOL. Despite these limitations, the US DOL has stated that “this prohibition is not intended to, and should not, impair the ability of contractors to utilize a commercial poster service that might provide the instant employee notice consolidated onto one poster with other Federally mandated labor and employment notices, so long as such consolidation does not alter the size, color, or content of the poster provided by the Department.” (Final Rule Implementing Executive Order 13496.) Also, when a significant portion of the contractor’s workforce is not proficient in English, the regulations require the contractor to post the US DOL’s translation of the employee notice in the languages spoken by the workforce.
