Who must post the California Minimum Wage Supplement for Health Care Workers Poster?

Every employer that is covered by the health care worker minimum wage must post a copy of the California Minimum Wage Supplement for Health Care Workers Poster and keep it posted in a conspicuous location frequented by employees during the hours of the workday. (Cal Lab. Code §§ 1182.14, 1182.15).

What is covered on the poster?

The poster shows the minimum wage rate for health care workers employed the following facilities:

• Health care facilities with 10,000 or more full time equivalent employees
• Dialysis clinic
• Intermittent clinics, community clinics, rural health clinics, or urgent care clinics associated with community or rural health clinics, except for those that have been granted a waiver to postpone the minimum wage increase
• Hospitals with a higher governmental payor mix, independent hospitals with an elevated governmental payor mix, or rural independent health care facilities
• Covered Health Care Facilities run by Large Counties (more than five million people as of 1/1/23)
• Covered Health Care Facilities run by Medium Sized Counties (250,000 to five million people as of 1/1/23)
• Covered Health Care Facilities run by Small Counties (less than 250,000 people as of 1/1/23)
• Other covered health care facilities

What types of health care facility employers are covered?

The poster includes links to databases that allow users to look up a specific health care facility, identify its facility type, and determine the applicable minimum wage rate.

California health care minimum wage rates apply to health care employees who work in:

• Facilities or other work sites that are part of an integrated health care delivery system
• Licensed general acute care hospitals
• Licensed acute psychiatric hospitals
• Psychiatric health facilities
• Licensed skilled nursing facilities, if owned, operated, or controlled by a hospital or integrated health care system
• Licensed residential care facilities for the elderly if affiliated with an acute care provider or owned, operated or controlled by a general acute care hospital or acute psychiatric hospital
• Licensed home health care agencies
• Physician groups
• County mental health facilities
• County correctional facilities (e.g. jails) that provide health care services
• Licensed mental health rehabilitation centers
• Outpatient clinics including:
  • Dialysis clinics
  • Psychology clinics
  • Medicare-certified ambulatory surgical centers
  • Urgent care clinics
  • Rehabilitation clinics providing physician services and two or more specified therapies
  • Alternative birth centers

Who must be paid the specified minimum wage rate?

The specified minimum wage rate applies to:

• Employees of the covered health care facility.
• Employees contracted or subcontracted to work primarily (at least 50% of the time) on the premises of a covered heath care facility, for all hours worked providing patient care, health care services, or services supporting the provision of health care.
