Who must post the California Minimum Wage Supplement for Health Care Workers Poster?
Every employer that is covered by the health care worker minimum wage must post a copy of the California Minimum Wage Supplement for Health Care Workers Poster and keep it posted in a conspicuous location frequented by employees during the hours of the workday. (Cal Lab. Code §§ 1182.14, 1182.15).
What is covered on the poster?
The poster features the health care worker minimum wage rates effective October 16, 2024, for the following facilities:
- Health care facilities with 10,000 or more full time equivalent employees – $23 per hour
- Dialysis clinics – $23 per hour
- Hospitals with a higher governmental payor mix, independent hospitals with an elevated governmental payor mix, or rural independent health care facilities – $18 per hour
- Intermittent clinics, community clinics, rural health clinics, or urgent care clinics associated with community or rural health clinics except for those that have been granted a waiver to postpone the minimum wage increase – $21 per hour
- Other covered health care facilities – $21 per hour
The Poster also:
- Identifies future scheduled of minimum wage rate increases and effective dates, and excluded facilities.
- Provides links to lists identifying specific covered heath care facilities.
What types of health care facility employers are covered?
- Facilities or other work sites that are part of an integrated health care delivery system
- Licensed general acute care hospitals
- Licensed acute psychiatric hospitals
- Psychiatric health facilities
- Licensed skilled nursing facilities, if owned, operated, or controlled by a hospital or integrated health care delivery system or health care system
- Licensed residential care facilities for the elderly if affiliated with an acute care provider or owned, operated or controlled by a general acute care hospital or acute psychiatric hospital or its parent entity
- Licensed home health care agencies
- Physician groups, as specified
- County mental health facilities
- County correctional facilities (e.g. jails) that provide health care services
- Licensed mental health rehabilitation centers
- Outpatient clinics including:
- Dialysis clinics
- Psychology clinics
- Medicare certified ambulatory surgical centers (except private practice surgery centers, unless the facility is otherwise covered)
- Urgent care clinics
- Rehabilitation clinics providing physician services and two or more specified therapies (except private practice physical therapy clinics, unless the facility is otherwise covered)
- Alternative birth centers
- Community clinics, intermittent clinics, and certain publicly operated clinics
- Hospital clinics
- Teaching clinics and nonprofit clinics providing health care, medical research, and health education
- Rural health clinics
Who must be paid the specified minimum wage rate?
The specified minimum wage rate applies to:
- Employees of the covered health care facility.
- Employees contracted or subcontracted to work primarily (at least 50% of the time) on the premises of a covered heath care facility, for all hours worked providing patient care, health care services, or services supporting the provision of health care.
