California Labor Law Notification: Wage Theft Protection Act Notices

Don’t delay all California employers must provide each employee at the time of hire with a written notice that contains specified information such as rate(s) of pay, designated pay day, the employer’s intent to claim allowances (meal or lodging) as part of the minimum wage, and the basis of wage payment (hourly, shift, day, week, piece, etc.), including any applicable rates for overtime. It is important to note that the notice must be provided in a language the employer normally uses to communicate employment-related information to employees.

Templates of the notices are available in the following languages:

  1. English
  2. Spanish
  3. Chinese
  4. Korean
  5. Tagalog
  6. Vietnamese

Visit the California Division of Labor Standards Enforcement (DLSE) to obtain these notices.

The templates can be used as approved by the State or an employer may develop their own notice as long as it contains all of the information as required by law. An employer should keep a record of the notice they provide to their employees. The notice can be given electronically but there needs to be a system where the worker can acknowledge the receipt of the notice and print out a copy of it.
