Louisiana Labor Law Posters Updated with New Mandatory Worker Misclassification Notice

Louisiana Employment Security Law was recently amended to require EVERY employer to post a state-mandated notice regarding misclassification of employees as independent contractors.

The new “Independent Contractor or Employee?” posting advises all employees, employers, independent contractors and subcontractors of:

  • Factors that describe independent contractors,
  • Rights regarding unemployment and workers’ compensation benefits,
  • Employee protections from retaliation,
  • Contact numbers for classification information and complaints,
  • Independent contractor tax payment responsibilities,
  • Consequences for misclassifying workers, and
  • Legal warning against misclassification.

The new posting requirement is intended to prevent fraud and ensure the proper collection and administration of contributions toward unemployment and workers’ compensation benefits, state and federal taxes, and other protections and penalties for misclassification of workers. The law became effective August 1, 2012.

I started to collect unemploymen I started to collect unemployment benefits actively actively searching every week for jobs weekl weekly claims all of a sudden all of a sudden my benefits stop it I and I could appeal the reason is that I and sig and sign up I did go to my local Career Center as directed hav I did go to my local Career Center as directed have proof talk to th state representati I would receive my benefits I have been 3 week three weeks with n I would receive my benefits I have been three weeks with no benefits I’ve done nothing wron the higher websit is a mess the new updated phone service is a mass I found out 1200 people lost thei I found out 1200 people lost their benefits fro I was told the benefits wou corrected I have been three weeks with no I would like to know if anyon I would like to know if anyone else has suffer has suffered this or in right or in right now Louisiana I have filed Career Center told me not to because the probl Career Center told me not to because the problem with going to resolve itself spoke wit with a rep I have been with ou without with out money for I have been with out money for 3 weeks $450 I have been trying to find a job I have d I have been trying to find a job I have done everything they asked me to do this is injustice. I have received conflicting information from 1 says do nothing 1 says do something both say 1 says do nothing 1 says do something both say it was a glitch in the system working on problem but three weeks without money very hard to look for job when you can’t afford to pay for gas
