US DOL Expands FMLA Protections under New Final Rule – New FMLA Poster Required

The US Department of Labor today published a new Final Rule expanding military-related leave protections under the Family and Medical Leave Act (FMLA).  The Final Rule is effective March 8, 2013.

The Final Rule implements two important expansions of FMLA protections. The first expansion provides families of eligible veterans with the same job-protected FMLA leave currently available to families of military service members and it also enables more military families to take leave for activities that arise when a service member is deployed. The second expansion modifies existing rules so that airline personnel and flight crews are better able to make use of the FMLA’s protections.

The US DOL has also released a new FMLA posting that all employers are required to post. New to the posting are terms related to service member medical care, veterans, “serious injury or illness” and “serious health condition”, and the airline flight crew special hours of service requirement.
