Conforming State and Federal Minimum Wage Legislation

President Obama recently called for congress to raise the minimum wage rate to $9.00 per hour. That prompted New York’s Speaker Sheldon Silver, Assemblymen Keith Wright, and new Labor Committee Chair Carl Heastie to align New York legislation to match the President’s proposal.

Currently the New York minimum wage is $7.25 per hour and has only increased by 10 cents in the last six years. It was raised with the federal wage back in 2009, from just over $7.00 per hour. New York’s minimum wage law lacks an indexing element so it does not increase based on the Consumer Price Index (CPI), as do other states.

In fact there are 10 states (Arizona, Colorado, Florida, Missouri, Montana, Nevada, Ohio, Oregon, Washington, Vermont) and four city’s (Albuquerque NM, San Francisco CA, San Jose CA, and Santa Fe NM) that increase their minimum wage rate based on adjustments in the CPI. All of the above state’s and city’s, except Washington, have mandatory-to-post minimum wage posters that must be displayed in the workplace for employees to view.

New York legislators are trying to do their part during the 2013 legislative session. Should the proposed minimum wage legislation be enacted it includes indexing so that wages do not erode in the future.
